General Terms of Use — ONLY Apartments Referrers App

Version 1.0 — Effective from June 2026

1. Service provider information

In compliance with article 10 of Spanish Law 34/2002 (LSSI-CE), we inform you that the "ONLY Apartments Referrers App" service is provided by:

2. What this App is

The ONLY Apartments Referrers App is a tool for self-employed individuals and businesses who wish to recommend to ONLY Apartments owners of properties in Mallorca interested in selling or renting. The specific contractual relationship between the user and ONLY Apartments is governed by the Referrer Agreement, which the user accepts upon registration.

These Terms regulate only the use of the App as a technological tool.

3. Requirements to use the App

To use the App, the user must:

  • Be of legal age and have legal capacity to contract.
  • Be registered as self-employed (RETA) or have a duly incorporated Spanish company with a valid tax ID.
  • Be up to date with tax and Social Security obligations.
  • Accept the Referrer Agreement and the Privacy Policy.

ONLY Apartments may verify compliance with these requirements and suspend or cancel accounts that do not meet them.

4. User account

The user is responsible for the confidentiality of their access credentials. Any activity carried out from their account is attributed to them.

If the user suspects their account has been compromised, they must notify info@onlyapartmentsre.com immediately.

5. Acceptable use

The user undertakes to:

  • Use the App only for its intended purposes (transmission of qualified leads, profile management, commission consultation).
  • Not enter false or fabricated data.
  • Not enter data of persons with whom they have not had a prior real conversation about the operation.
  • Not use the App for commercial purposes of their own distinct from the recommendation to ONLY Apartments.
  • Not attempt to access unauthorized parts of the system or interfere with its operation.
  • Comply with applicable regulations, especially data protection.

Breach of any of these undertakings entitles ONLY Apartments to suspend or cancel the account and, where applicable, to claim damages.

6. Service availability

ONLY Apartments will endeavour to keep the App continuously available, but does not guarantee a specific service level (SLA) or freedom from interruptions due to maintenance, technical failures or force majeure.

In case of extended interruption, pending leads will be preserved and processed once service is restored, always within the 48-hour verification validity period.

7. Intellectual property

The design, code, brand, logos, texts and content of the App are owned by ONLY Apartments or licensed to it. The user obtains only a limited, non-exclusive right to use for the intended purposes.

Any reproduction, redistribution, reverse engineering or commercial use outside the framework of the Referrer Agreement is prohibited.

8. Liability

ONLY Apartments is liable for direct and foreseeable damages arising from its own breach of these Terms, within the limits permitted by Spanish law.

It is not liable for:

  • Indirect damages, loss of profit or loss of opportunity of the user.
  • Damages arising from the entry of false data by the user.
  • Damages arising from the user's breach of the warranties in the Referrer Agreement (especially data protection).
  • Service interruptions caused by third parties (hosting providers, messaging providers, etc.) or by force majeure.

9. Term and termination

Use of the App is linked to the Referrer Agreement. Termination of the latter entails closure of the account.

ONLY Apartments may cancel accounts inactive for more than 12 months, after 30 days' prior notice.

10. Modification of the Terms

ONLY Apartments may modify these Terms, notifying users at least 15 days in advance. Continued use of the App after modification implies acceptance. If the user does not accept the changes, they may close their account free of charge.

11. Governing law and jurisdiction

These Terms are governed by Spanish law. For any dispute, the parties submit to the Courts of Palma de Mallorca, unless consumer law imposes a different forum (the Referrer acts, in this service, as a professional, not as a consumer).
